Terms of Use

These terms apply to your use of Ergon Energy’s Made Better site and its online volunteering portal.  If you use the portal as a representative of an organisation, such as a not-for-profit or educational institution you expressly warrant and confirm that you are authorised to accept the terms of this User Agreement on behalf of the relevant organisation, and understand that you are obliged to comply with them. 

Changes

These terms were last changed on the date set out at the top of this page. These terms may be changed at any time by an updated version being published on the system. You will be required to accept the changed version if you wish to access the system after any change.

The information and material contained in this site is of a general nature and does not constitute advice. You are advised to seek independent professional advice before making any decisions.  

You are welcome to download this information for your own personal use or to inform others about our businesses, products and services. You must not do anything to alter or modify the information in this web site.

The information and material contained in this site is subject to copyright which is owned by Ergon Energy. As provided by the Copyright Act 1968 or any other applicable laws, no part of this site may otherwise be copied, reproduced, adapted or transmitted in any form without the written consent of Ergon Energy. If consent is provided, it will be subject to the requirement that the copyright owner’s name and interest in the material be acknowledged when the material is reproduced or quoted, in whole or in part. 

Social Media

Although Ergon Energy takes care in producing the content for social media sites, it does not guarantee that the information is accurate, complete, or current, or that the data is free from defects of malicious code such as viruses. 

Ergon Energy does not accept any responsibility to you if you incur any loss or damage (however it was caused) in connection with the use of social media sites or any website it links to. 

Ergon Energy may not have any control over content contained on other websites, including sites link to from social media sites. 

Just because Ergon Energy links to another site or follows other accounts does not mean that Ergon Energy endorses or approves of that site, the account, its operators, or any particular content on that site.  

Your Account

The Made Better website will be hosted in a segregated hosting environment in the Amazon Web Services Sydney datacentre. Personal information will be stored in a secured MySQL database.  

We will use the contact information you provide when you create a Made Better account to keep you updated on Ergon Energy’s community initiatives.

Information uploaded by an account holder

• You confirm that when you upload your organisation’s logo, documents as requested by us or any photos or video content that you are authorised to do so on behalf of your organisation. 
• You confirm that appropriate permissions have also been obtained from any individuals featured in the content provided such that Ergon Energy may use the content uploaded at its sole discretion. 
• By uploading this information to the Made Better site you are providing Ergon Energy with express permission to republish this information on the Made Better site, and that the content may be used by Ergon Energy on our website, social media channels and in any marketing material deemed appropriate by us in relation to promotion of the Made Better program of work without first obtaining your consent to do so.  
• You agree that you will not upload any material which infringes another person’s confidentiality, intellectual property, copyright, or any other rights.
• You undertake not to upload any material which Ergon Energy may consider in its sole discretion to constitute defamatory, threatening, offensive, misleading or deceptive material.
• You understand that Ergon Energy may at any time without notice to you elect to remove material which you have uploaded if it reasonably considers that the user’s material does not comply with the terms of this Made Better User Agreement.
• You understand that once you upload material onto the Made Better site, that it may be seen or accessed by other users and any confidentiality associated with the uploaded material may be compromised.

Representations, warranties and liability

• To the extent permitted by law, Ergon Energy excludes all implied warranties relating to the content contained on the Made Better site.
• Ergon Energy accepts no liability whatsoever to any user in relation to the use of the site, its content or any reliance that a user may place on its content.   
• In using the site, the user expressly acknowledges that they do so at their own risk.

Governing law

The terms of the Made Better User Agreement are governed by the laws in force in the State of Queensland and you agree to submit to the exclusive jurisdiction of the Courts in the State of Queensland.
